Privacy Policy

The Dave Thomas Foundation for Adoption (the “Foundation,” “we,” “us,” or “our”) is committed to respecting the privacy of its donors. This Privacy Policy applies to personal information received by the Foundation from our donors and describes our policies and procedures for collecting, using, retaining, and protecting your personal information. By submitting your personal information to us, you consent to the terms and conditions of this Policy. For more information about the types of data and information that are collected by visiting our websites, please review our Legal Privacy Policy.

We only collect personal information voluntarily provided to us; however, such information may be obtained in a variety of ways, including when you donate, register for an event, sign up to receive communications, or otherwise interact or communicate with the Foundation. Depending on the type of communication or transaction, the Foundation may collect, process, and retain the following data:

  • Contact information (name, address, phone number and email address)
  • Giving history (note: payment card information is processed securely by third-party payment processors and is not stored by the Foundation)
  • Comments and suggestions provided by the donor
  • Event participation or volunteer information
  • Research from third party platforms and publicly available sources to identify affinities, capacity and propensity to support the Foundation’s mission
  • Website usage information, such as IP address or basic analytic data, collected through cookies or similar technologies
  • Any other relevant information you share with us about yourself, including without limitation your individual giving and communication preferences, interests and affiliations with other charities, community groups or your employer

We may use the information collected for the following purposes:

  • To fundraise and tailor our communications with you
  • To process donations and carry out our obligations to you as a donor or supporter
  • To send you information about events or stories that we believe may be of interest to you
  • For Foundation-related marketing and other purposes
  • To comply with legal, regulatory or reporting requirements
  • For any other purposes for which you have given consent

The Foundation may also process your information through its use of data analytics and, in some cases, artificial intelligence (“AI”) to support its fundraising and donor communication activities, including without limitation, to:

  • Determine which donors or prospective supports to contact and when
  • Personalize the content in our fundraising communications
  • Analyze publicly available information and third-party data to assess a donor’s interest in or capacity to support the Foundation’s mission

While these tools assist our staff in making decisions, they do not replace human judgment. All significant decisions about donor engagement or that otherwise produce legal or similarly significant effects on individuals are made by Foundation staff. The Foundation will not use information processed through AI or automated tools to discriminate against any donor or prospective donor on the basis of race, ethnicity, national origin, religious beliefs, disability, sexual orientation, gender identity, or any other protected characteristic. The Foundation is committed to updating this policy to reflect material changes in how we use AI technologies as they continue to evolve.

The Foundation does not sell personal information or data; however, we may share your personal information in the following limited circumstances:

  • With service providers: We may share information with service providers who provide services or administer activities on our behalf (such as for donation processing, mailing or data management purposes). We only share your information with these service providers when such disclosure is necessary for the service providers to perform their duties. These partners are required to protect the confidentiality of personal information to maintain standards consistent with this policy, and to use such information solely for the purpose for which such information was provided. We may also share your information with third-party platforms that we use to conduct donor research, wealth screening, propensity analysis or for other automated decision-making purposes. Our service providers are required to protect personal information and data.
  • Legal requirements: We may disclose information when required by law or in response to a valid legal request.
  • With consent: We may share information for purposes for which you have explicitly given consent.
  • With select third parties: Donor information is not sold or rented, but in limited cases, certain donor information may be shared or exchanged with select third parties. Donors may opt out of any such sharing at any time (see “Your Rights” below).

The Foundation does not share text messaging originator opt-in data and consent with any third parties and/or affiliates, excluding aggregators and providers of SMS (“text”) messaging services. For more detailed information about privacy pertaining to the Foundation’s Text Messaging Program, please see the Foundation’s Text Messaging Program Terms and Conditions.

You have the right to:

  • Access, delete, or correct your personal data or information
  • Opt out of the sharing of your personal data or information with third parties
  • Opt out of the processing of your personal data for purposes of targeted advertising or profiling in furtherance of decisions that produce legal or similarly significant effects concerning you
  • Opt out of receiving fundraising or marketing communications from us

To make any of these requests, please contact us using the information below.

Notwithstanding the individual donor rights outlined above, the following records and types of donor information are permanently retained by the Foundation:

  • Donor contact information and communications
  • Records of gifts, trusts, and endowments, including gift agreements, acknowledgment letters, and appraisals
  • Private grant records, including proposals, applications, agreements, and reports
  • Records of disposition of donated goods, including sale of securities and property

The Foundation protects all personal information with password protected safeguards appropriate to the sensitivity of the information. Safeguards are in place to protect personal information against loss or theft, as well as unauthorized access, disclosure, copying, use or modification, regardless of the format in which the information is held. The Foundation informs employees and volunteers of the importance of maintaining the confidentiality of personal information, and exercises care in the disposal or destruction of this information to prevent unauthorized parties from gaining access.

If you give us your phone number and opt in to receiving text messages through the Foundation’s Text Messaging Program, we may text you marketing messages regarding Foundation programs, events, or donation opportunities.

You may opt out of receiving text messages from us at any time. To opt out, simply text the word “STOP” to the number from which you received a message. By texting “STOP,” you are providing your express consent to opt out of the Foundation’s Text Messaging Program, and the Foundation will promptly remove your phone number from our Text Messaging Program. After you text “STOP,” we will send you a text message to confirm that you have been unsubscribed from the Foundation’s Text Messaging Program. After this, you will no longer receive text messages from us. If you do not receive a confirmation message within 24 hours or continue to receive texts from us, please contact us immediately at info@davethomasfoundation.org. If you would like to opt in to the program again, just sign up as you did the first time and we will start sending text messages to you again.

If you are experiencing issues with the Text Messaging Program, text “HELP” for more assistance or contact us directly at development@davethomasfoundation.org.

Carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider directly.

Data provided by individuals to opt in to the Foundation’s Text Messaging Program is not shared with third parties for marketing purposes. If you have any questions regarding privacy generally, please read the Foundation’s Legal Privacy Policy.

The Foundation reserves the right to change this policy at any time. Please check our website periodically for changes. Any changes will be posted on our website with an updated effective date.
